“The oral presentation of a legal issue or problem”. A moot takes place before in a mock court of appeal. Two teams of two will stand before the Judge and present their legal argument. The participants in a moot are Junior and Senior Counsel for the Appellant, and Junior and Senior Counsel for the Respondent. Each of counsel present their legal arguments in speeches no more than 20 minutes long. The judge then gives their judgment on the points of law raised in the moot and on each team’s mooting ability. The team who wins is not the one who wins on the points of law, but the one who makes their arguments stonger.
As mooters must address judges in the appropriate manner and dress and behave accordingly, it provides participants with a very realistic experience of the workings of appeal courts, and as a result, it is an absolute essential for those students who are interested in a career at the Bar or would like to have higher rights of audience as a Solicitor. Mooting provides excellent experience in public speaking and thinking on one’s feet in a stressful situation. If you are interested in taking part in a moot you can get involved in internal competitions here at Oxford Brookes, or, you can take part in national competitions. For more information, please email our Master of Moots, Brian at brian@brookeslawsociety.co.uk.
